What has surprised me following the postal survey results is the "yes" campaign's sudden turnaround to effectively ignore the need to protect basic freedoms that would otherwise be lost.

随着最高法院裁定同性婚姻立法公投可以如期进行,支持和反对双方的“选战”也进入白热化阶段。

Ever since the High Court dismissed challenges to the same-sex marriage postal survey, both the “Yes” and “No campaigns” have been building up their momentum. 

However, it is fair to say that the two campaigns are not competing on a level playing ground. The “Yes” campaign to redefine marriage has the help of a majority of mainstream media outlets which predict the “Yes” vote will win by a landslide. Prime Minister Malcolm Turnbull announced that he would vote “Yes”, and asked the public to do so as well. Rainbow flags are flying outside many councils. Darebin Council in Melbourne’s north even boldly declared that it would lend its office space to the “Yes” campaign for free.[i]

So what’s going on is a very serious debate, right at the heart of law about whether diversity will allow different views on marriage.

 “And in Australia you’re going to have to be absolutely aware, that your laws have to be crystal clear to protect freedom of religion and diversity.”

So how would that relate to the situation in Australia?

 “Well, the Australian provisions that I’ve seen put forward, are even weaker than the Canadian ones.

It is common ground in the same sex marriage debate that if the postal survey produces a Yes majority, then the people’s verdict should be respected and Parliament support an amendment to the Marriage Act. There is less generosity of spirit if the outcome is a No vote. Bill Shorten has said that his party will not accept such a result. Nor will the Greens.

This contest highlights just how important it is for the Government to spell out, before the postal survey is completed, what steps it will take to protect parental rights, freedom of speech, and religious freedom in the event of same sex marriage becoming law. The case for these protections is compelling given the experience of other countries such as the UK, US, and Canada in the wake of those countries changing their marriage laws.

WITH five weeks to go in the Same Sex Marriage postal plebiscite, the Yes vote is in free fall, especially among mothers, according to large-scale polling by the No campaign, revealed exclusively here.

Support for changing the Marriage Act has dropped to 51 per cent over the first four weeks of the campaign, with the No vote rising to 37 per cent.

The poll of 1200 people was taken on September 25, and has a margin of error of 2.5 per cent. It reflects a similar trajectory to a recent Newspoll.
